NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST A RELEASE OF FUNDS Date of Notice: April 7, 2021 City of Lynchburg, Virginia City Hall 3rd Floor 900 Church Street Lynchburg, VA 24504 (434) 455-3990 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Lynchburg. REQUEST FOR RELEASE OF FUNDS On or about April 23, 2021 the City of Lynchburg will authorize Lynchburg Redevelopment and Housing Authority to submit a request to the U.S. Department of Housing and Urban Development (HUD, Richmond Field Office, Public and Indian Housing Division (PIH) for the release of Housing Choice Voucher (Project Based Vouchers) funds under Section 8(o) of the United States Housing Act of 1937 (42 U.S.C1437f), as amended, to undertake a project known as Miller's Rest Apartments, LP for the purpose of creating new affordable housing. Located at 6100 Old Mill Road, Lynchburg, VA 24502, Miller's Rest Apartments, LP will contain 80 multifamily units. The project's purpose is to provide new, high quality affordable housing in Lynchburg, Virginia. It will consist of two, four-story buildings containing 1-, 2-, and 3-bedroom apartment units and a club house/rental office building which will include laundry facilities and dedicated amenity space. Miller's Rest Apartments, LP will contain 8 Project Based Vouchers. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Lynchburg, 900 Church Street #100, Lynchburg, VA 24504. A copy of the report will also be at the Lynchburg Redevelopment and Housing Authority, 918 Commerce Street, Lynchburg, VA 24504. ERRs and may be examined or copied weekdays 8:00 A.M to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Lynchburg, 900 Church Street #100, Lynchburg, VA 24504. All comments received by midnight April 22, 2021 will be considered by the city of Lynchburg prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The city of Lynchburg certifies to HUD that Mr. Reid Wodicka in his capacity as Interim City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities which allows the Lynchburg Redevelopment and Housing Authority to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The HUD Richmond Field Office, Public and Indian Housing Division, will accept objections to its release of funds and the city of Lynchburg's certification for a period of fifteen days following the anticipated submission date or its actual date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the city of Lynchburg; (b) the city of Lynchburg has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR, Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR, Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR, Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Mr. Robert Davenport, Director, Public and Indian Housing Division (PIH), HUD Richmond Field Office, at 600 East Broad Street, Richmond, VA 23219-1800.
