PUBLIC NOTICE The Lynchburg Planning Commission will hold a public hearing for citizen comment on October 28, 2020, at 4:00 p.m., in the Council Chamber, first floor, City Hall, 900 Church Street, on the following matters: Consideration of amending Zoning Ordinance Section 35.2-45, Limited Business District (B-1) to clarify that "Mixed Use Developments" may not exceed 50,000 square feet of gross floor area per lot, prohibit ground floor residential uses except when authorized or by conditional use permit, require multi-story buildings to not exceed 2 stories when within 100 feet of the property line of an abutting R-1, R-2 or R-3 District, require commercial space to comprise at least 50% of the building gross floor area of a mixed use development permitted by right and to require a mixed use development to establish a fence not less than 6 feet in height when adjacent to an R-1, R-2 or R-3 District. Consideration of amending Zoning Ordinance Sections 35.2-46.4 B-3 District Development Standards and 35.2-48.4 B-5 District Development Standards to require commercial space to comprise at least 50% of the building gross floor area in a mixed use development permitted by right and to prohibit ground floor residential uses except when authorized or by conditional use permit. Consideration of amending Zoning Ordinance Section 35.2-61.2 (d) to add the Limited Business District (B-1) to the standard of how building height is measured when abutting an R-1, R-2 or R-3 District. Consideration of amending Zoning Ordinance Section 35.2-61.3 (j) to provide for a 50 foot setback in a Limited Business District (B-1) when abutting R-1, R-2 or R-3 Districts. City Council is tentatively scheduled to hear the petitions on November 10, 2020, at 7:30 p.m., in City Council Chamber, first floor, City Hall, 900 Church Street. A copy of all draft ordinances, Future Land Use Map amendments, rezoning, conditional use permit petitions or any other matter advertised by this legal notice may be viewed in the Department of Community Development, Planning Division, second floor, City Hall, 900 Church Street between the hours of 8:30 a.m. to 5:00 p.m. or on the internet at www.lynchburgva.gov. At the conclusion of the public hearing, the Planning Commission/Council will consider adopting each item advertised by this legal notice.
