NOTICE OF TRUSTEE'S SALE OF REAL ESTATE AMHERST COUNTY, VA 24521 TAX MAP # 78-A-3,5 In execution of a deed of trust in the principal amount of $302,250.00, dated May 21, 2020, and recorded in the Office of the Clerk of the Circuit Court of the County of Amherst, Virginia, at Instrument Number 200001571, granting and conveying to Seth E. Twery, P.C., Trustee, certain real estate, in trust, thereafter Brinson C. White II was appointed substitute trustee by Appointment of Substitute Trustee dated November 17, 2022 and recorded in the Circuit Court of the County of Amherst, Virginia at Instrument Number 220004175. The substitute trustee will offer for sale at public auction on the front steps of the Courthouse located at 113 Taylor St Amherst (Amherst County), Virginia 24521 on the 26th day of July, 2023 at 12:00pm noon, the real estate parcels lying in the County of Amherst, Virginia and more particularly described as follows: PARCEL 1: That certain tract or parcel of land, together with any buildings and improvements thereon and the privileges and appurtenances thereunto belonging, situated in the Pedlar Magisterial District of Amherst County, Virginia, on the Ware's Gap Road leading from Pleasant View and containing 87 acres, more or less, adjoining the lands now or formerly owned by L.V. Burch, C.C. Myers and others; the dwellings thereon being known as 192 Opus Lane, 225 Opus Lane and 231 Opus Lane, Amherst, Virginia. PARCEL 2: That certain lot or parcel of land, together with any buildings and improvementsthereon and the privileges and appurtenances thereunto belonging, situated in the Pedlar Magisterial District of Amherst County, Virginia, containing 6 acres, more or less, and lying on the north side of Ware's Gap Road and being all of the land of Russell Hughes, widower, which was cut off by the Ware's Gap Road. The sale is subject to conditions, covenants, restrictions, reservations, party wall rights, easements, rights of way and other matters of record applicable to the property, and the real estate taxes from the date of the sale. Property is sold as is, where is, without any duty of the Trustee to obtain possession for the purchaser. TERMS OF SALE: Cash: A deposit of 5% of the sales price or $5,000.00, whichever is less, by bank's cashier's check payable to the Trustee may be required of the successful bidder at the time of sale, with the balance due within fifteen (15) days of sale. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the Trustee's compensation authorized by the Deed of Trust and the law in such cases. All costs of conveyance, which shall be by Special Warranty Deed, examination of title, recording fees, notary fees, settlement fees and Grantor's tax, to be at the cost of the purchaser. The Trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement.
